Terms of use

1. Scope and provider

These terms govern the use of EverySlab (https://everyslab.com), a web service that publishes Pokémon card price information, fair-value estimates, deals and optional watchlist alerts.

The provider is Manta Technologies GmbH, Erich-Weinert-Str. 10, 10439 Berlin, Germany (see the imprint). Contact: info@everyslab.com.

2. Language

These terms are provided in English and German. If the versions differ, the German version is legally binding.

3. The service

EverySlab is currently free of charge. There is no payment, subscription or paid plan. If we introduce paid features later, they will be covered by separate terms and we will tell registered users before those features apply to them.

Some accounts may be placed on a waitlist before watchlists and alerts are enabled.

4. Account

An account requires a valid email address and accurate information. One account per person. Keep your sign-in credentials safe. You are responsible for activity under your account.

We may suspend or disable accounts in case of abuse, security risk, or a material breach of these terms.

5. Permitted and prohibited use

You may use EverySlab for your own information, including setting watchlists and receiving alerts.

You must not:

• scrape, crawl or otherwise access EverySlab by automated bulk means, except ordinary use of a generally available web browser or our published interface;
• reverse engineer the service except where mandatory law allows it;
• abuse alerts (for example by creating accounts or watches solely to overload the system);
• interfere with the security or availability of the service;
• use the service for unlawful purposes.

6. Information only — no advice

Prices, fair values, discounts and deals are automated estimates from third-party market data. They may be wrong, incomplete or out of date. They are not investment, financial or purchase advice and they are not an offer to buy or sell.

We do not guarantee the availability, authenticity, condition or grading of any listing. Always check the listing, scans and seller on the marketplace before you buy.

7. Purchases on third-party platforms

Purchases take place exclusively between you and third-party sellers on Cardmarket or other platforms. EverySlab is not a party to those contracts, does not process payments and does not hold cards.

8. Third-party links

The service contains links to third-party websites. Those sites are outside our control. Their terms and privacy policies apply once you leave EverySlab. See also our privacy policy.

9. Availability

We do not guarantee uninterrupted or error-free operation. Features may change, be limited or be discontinued. Maintenance, outages and third-party failures can interrupt the service.

10. Intellectual property

EverySlab’s own content, software and the compilation of market data are protected. You may not copy the service or its data compilation for a competing product.

Pokémon and card names and images belong to their owners. EverySlab is not affiliated with Nintendo, Creatures, GAME FREAK, The Pokémon Company, Cardmarket, PSA, BGS/Beckett, CGC, TAG or ACE.

11. Liability

We are liable without limitation for intent and gross negligence, for injury to life, body or health, and under the German Product Liability Act.

For slight negligence we are liable only for breach of essential contractual obligations (duties whose fulfilment is necessary for the proper performance of the contract and on which you may regularly rely), and only for the foreseeable damage typical for this kind of service.

Because the service is currently provided free of charge, liability for a gratuitous favour may also be limited under sections 521, 523 and 524 of the German Civil Code (BGB). The unlimited liability in the first paragraph of this section remains unaffected.

We are not liable for the content, availability or performance of third-party marketplaces or for transactions you conclude there.

12. Termination

You may stop using the service at any time and request deletion of your account by emailing info@everyslab.com. There is currently no in-app delete button.

We may terminate the service or an account with reasonable notice, or immediately for good cause (including the prohibited uses above).

13. Changes to these terms

We may change these terms if the service or the law changes. We will notify registered users by email. If you object before the stated effective date, the previous terms continue until the contract ends; we may then terminate the account with reasonable notice. Continued use after the effective date without objection constitutes acceptance.

14. Governing law

These terms are governed by the law of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). This does not deprive consumers of the mandatory protections of the law of the country in which they reside.

15. Severability

If a provision of these terms is or becomes invalid, the remaining provisions stay in force. The invalid provision is replaced by the valid rule that comes closest to the intended purpose.
